Help!!!

OK, as some of your regulars know I am in the last stages of selling my home. Now the buyer is being difficult. He is reneging on part of the contract. This is after the agreed closing date and after he wired the money. I was told of the buyer's change of mind as the movers were taking the stuff out of my home!

He now is not responding to calls from my agent or myself.

Also, my broker is a bitch. She is pressuring me to close on terms that are not in my best interest.

So I guess I need help cleaning up any obstacles that may causing this to occur at such a late stage in the game. I should have been out of CA by now. I realize that things happen for a reason but I am living out of boxes!!!

I want to close the sale and get the heck out of dodge but something is blocking it. Help!

Thanks again all! Everything happens for a reason.
I am hanging in there and I know deep down it will all work to my advantage in the end. Somehow.

In the meantime I am reading blogs on here from Levi (and everyone else who contributes) and trying to get prepared for much bigger things! Thanks all!

Glad to hear you can take another direction, really hope it all works out for you and hope the move goes well.

The final stage of selling and buying a home is when the buyer, seller, and both agents meets to discuss the contract and sign over the title of the real estate to the new owner through a title company. After this process is complete, the money from the mortgage company that the buyer is borrowing from will be wired to you or the bank you still have your mortgage on. The deal is complete after the money is successfully wired.

With this said, anytime before the final stage can be interrupted by things such as the buyer not having enough income for the down payment, their final credit check not passing anymore, and etc. The buyer also could have change in terms or condition at the last moment such as seeing a problem with the property after the final walk through the day before closing or a few hours before closing. The seller has to come with an agreement with the buyer and both party needs to have it documented with an addendum on the new agreement. New agreement could be things such as the buyer see a problem with a water leakage in the bathroom and the seller has to fix it or provide the funds for it to be fix prior to closing. Anything could be solve, it's just a matter of both party agreeing to a solution.

Just remember that if you don't like the condition and you can't agree to it, you are able to terminate the purchase agreement. If your realtor is pressuring you, find a new realtor and broker to work with.

Is the money in your account?

Tell him there is no negotiating at this stage things stand as how the contracts stated.

Move the money to another account and tell him you will keep the money until he either stops being so silly or you have another buyer who has the decency to stick with the agreed contract and the move has gone through.

Tell your biatch of a broker theres no payment for her either until the move has gone ahead exactly as the contract stated.

I don't know how these things work just thoughts off the top of my head.

They used to call this "Gazumping" in the UK.
Its a con to make you panic and drop price or pay expenses the buyer should be paying for.

Threaten to slap interest on them per day if they insist on breaking contract. As above move any money into a safe place.

Your agent is in on this. Threaten to dismiss her shoddy service and to take action if she gets snotty. I would dump her anyway. Shes supposed to be on your side so must be up to some scam or other.

Levi told me some time ago that since the downturn a lot of people and businesses are resorting to penny pinching scams to prop up falling profits. Check your bills as well because some will try charging twice.

Failing all advice above get a baseball bat and give them the business.
